Thursday afternoon, US District Court Judge Stanley Sporkin will issue a permanent injunction barring the Navy from discharging senior chief petty officer Timothy McVeigh. Judge Sporkin had issued a preliminary injunction on Monday, ruling that the Navy overstepped the bounds of the Electronic Communications Privacy Act and its own "Don't Ask, Don't Tell, Don't Pursue" policy. McVeigh, a 17-year veteran, was threatened with expulsion after Navy investigators obtained information from AOL indicating that McVeigh had used the word "gay" in his online profiles.
